Thanks to you, the efforts of the TOMA PAC have been successful and are growing!
This report is made to you, the contributors and supporters of the Political Action Committee, to demonstrate the actions of the PAC, its board and the effects of our support and to be accountable to you.
Your contributions have really helped make a difference. They allow the voice of osteopathic medicine to speak with strength and veracity in the efforts to advocate for relevant health care issues and proposals.
We have faced some serious issues in the recent legislative sessions, such as tort reform, workers compensation and the Board of Medical Examiners. There will be expected and unexpected issues coming up in coming months and sessions, including taxes for school finance. We need to have to a strong base of support from our legislators, fostered by their understanding of the issues and their awareness of the value of osteopathic medicine to the citizens of Texas. The continued partnership between you and the TOMA PAC will help achieve that.

Annual Report
Texas Osteopathic Medical Association PRIVATE Political Action Committee
"TOMA-PAC"
Introduction
This annual report is presented to the contributors and supporters of the TOMA-PAC in the spirit of accountability and outcomes.
The TOMA-PAC has been significantly successful in both contributions and distributions due to the hard work and diligent efforts of its leadership and of the members of the Texas Osteopathic Medical Association (TOMA). Members of TOMA have realized the value to financial support to key legislators and demonstrated that through their contributions. The results have been very positive. Distributions were made on the basis of opportunity to work on health care issues, first, their likelihood to support health care issues in our state based on their record, second, and thirdly, the legislators’ votes on tort reform in the previous session. The leadership of the foundation had a number of long and hard discussions on this subject but came through with a workable plan that produced results. The TOMA-PAC is establishing its potency in the legislative advocacy process.
Every legislator supported by the PAC was either re-elected or elected to their office.
Purpose of the PAC
The TOMA-PAC is devoted to the protection and advancement of the healing arts and believe that physicians and members of the general public, through cooperation afforded by this Trust, can more effectively support candidates for political or public office who seek to promote osteopathic medical training, superior medical care, advancement of the healing arts and human welfare for all members of society.
The Trust is formed for the purpose of protecting and preserving and furthering the private enterprise system and to strengthen the American free institutions, and in particular the protection and advancement of the healing arts, especially as it applies to the School of Osteopathic Medicine. To further these objectives, the Trust is directed to receive contributions and expend the contributions so received by means of direct financial contributions to candidates for public office who it is believed are in general agreement with the objectives of TOMA-PAC.
Leadership
Trustees of the TOMA-PAC Trust shall also be members of the Executive Committee of the Texas Osteopathic Medical Association. All Trustees shall be members in good standing of the Texas Osteopathic Medical Association or its affiliated member organizations.
The voting Trustees shall consist of the members of the TOMA Executive Committee, TOMA Executive Director, and the chairman of the TOMA Governmental Relations Committee. There shall be three (3) non-voting, ex-officio trustees, the President of the Advocates (Auxiliary) to the Texas Osteopathic Medical Association, one (1) intern/resident/fellow member, and one (1) student member from the TCOM Student Government Association.
The chairman of the TOMA Governmental Relations Committee will annually be appointed as chairman for the purpose of continuity between TOMA's Governmental Relations program and TOMA-PAC. The chairman cannot serve as executive trustee and campaign treasurer.
Executive Trustee
The Executive Director of the Texas Osteopathic Medical Association shall be appointed a Trustee of TOMA-PAC and shall serve as Trustee of TOMA-PAC so long as he remains Executive Director of TOMA. The Executive Director shall be the Executive Trustee and Campaign Treasurer, who shall perform such functions as may be assigned to him by this Trust Agreement and by a majority vote of the Trustees and as required by federal and state laws, rules and regulations.
Committeeman
The Trustees shall appoint State Committeemen. Each State Committeeman so appointed shall be a member in good standing of the Texas Osteopathic Medical Association or one of its affiliated member organizations. The State Committeemen shall be responsible for the solicitation of political gifts and contributions to the Trust. The State Committeemen shall operate in accordance with such rules and regulations as may be prescribed by the Trustees and shall comply with applicable provisions of the Texas Election Code and shall not accept contributions from corporate entities.
State Committeemen shall hold office until their successors shall be appointed and take office.
No person may serve as a State Committeeman, as hereinafter defined, while he also serves as a Trustee.
Contributions and Distributions
The Trustees and State Committeemen are authorized to accept contributions from any individual either in cash or other property which, when accepted by the Trustees, shall constitute an unidentifiable part of the Trust Estate. Trustees and State Committeemen may refuse to accept the contribution of any person when, in their opinion, the acceptance of such contribution would not be in the best interest of the Trust.

Priority of Distributions
The leadership of the PAC engaged in a number of intense and, at times, passionate discussions on the priorities for distribution of the funds this year.
The final decision established priorities as follows:
Serving on a committee that directly deals with consideration of health issues, and
Related to the first priority, likelihood to support health care issues based upon their past record, and
Voted for tort reform legislation in the previous session; those who met one of above priorities but did not support tort reform were given a lesser amount of contribution.
Senators who were up for election/re-election in this election were considered.
In addition, it was also approved to provide funding to individual legislators if so requested by a member of the Association.
